Maternity Leave benefits in India for working Women

Woman has a very crucial and delicate role in our lives whether she is a mother, a sister, a friend, a wife, a grandma, an aunt etc. We all know woman has a special boon as she can bring a new life to this world.Last amendment in Maternity Benefit Act, 1961, came in 2017, but don’t you think we still need to know more about it.

Owing to this our Government is giving many benefits to our sheroes & according to the act; it is made mandatory that woman should be aware of her rights.

Eligibility 

Every woman who is working in an establishment (Government bodies, Factories, shops and establishments, under the relevant applicable Legislations, or any other establishment as may be notified by the Central Government) at least for 80 days recently in past 12 months would be eligible. The establishment should have 10 or more employees.

Maternity Leave Duration

The duration is 26 weeks. It was 12 weeks before the Amendment of 2017 made. But now it is 26 weeks. The prenatal leave is extended from earlier 6 weeks to 8 weeks . For women who are expecting a child after already having 2 children, the duration of paid maternity leave shall be 12 weeks (i.e., 6 weeks pre and 6 weeks post expected date of delivery).

Wages

According to the act, the woman will be paid maternity benefit at the rate of her average daily wage in the three months as soon as the leave starts.

Awareness

It is made mandatory for the employer to inform the woman employee in writing & electronically about the benefits under the Maternity Benefit Act as soon as she joins the establishment.

 

Work From home 

After availing the maternity leave, the woman can work from home as per the mutual understanding between employer & employee.

Crèche Facility

After the 2017 amendment in the act,   the Crèche facility made mandatory for the establishments having 50 or more employees. Under the Crèche facility, women employee can visit the crèche 4 times during the day (including the breaks).

Benefits to Adoptive and Commissioning Mothers 

If woman adopts a child below 3 years of age, she can avail maternity leave of 12 weeks. Same benefit could be availed by commissioning mothers. (A commissioning mother is the one who uses her egg to create an embryo planted in any other woman.)
